Education

Andrew graduated from King's College London with a First Class degree in History, receiving a first class grade in all nine papers, obtaining the highest first of his year and the second highest in the past decade. Andrew completed the law conversion course at City University (Very Competent) and was awarded both a Major Scholarship (£20,000.00) and the Duke of Edinburgh Scholarship by Inner Temple. 

Profile

Andrew specialises in both Commercial and Employment law and is particularly interested in matters where these two disciplines intersect.  In the past 12 months Andrew has:

 

  • Successfully acted as sole counsel for a Financial Director of a Housing Association in a 15 day whistleblowing case before the Employment Tribunal and Employment Appeal Tribunal;

 

  • Continued to act as sole counsel against Burton Albion Football Club in relation to on-going commercial litigation regarding alleged defective building works carried out at the Pirelli Stadium; 

 

  • Successfully acted as sole counsel in a number of Sexual Orientation/Disability Discrimination claims on behalf of individuals suffering from HIV against their former employers;   

 

  • Acted (with Stuart Ritchie) in a commercial fraud matter, successfully recovering over £800,000;

 

  • Acted (with Selwyn Bloch QC and Gavin Mansfield) in a multi-million pound claim brought by an Insurance Company against its former employees following a team move to a competitor; and  

 

  • Acted (with Andrew Stafford QC) in 3 week whistleblowing trial in the Bristol Employment tribunal;

Andrew also regularly appears in the Employment Tribunal, Employment Appeals Tribunal, County Courts and High Court in multi-day hearings relating to various matters including employment injunctions, misrepresentation, breach of contract, civil fraud, discrimination, TUPE, and Wages Act claims (especially brought by hospital doctors against various NHS Trusts). 

Further, Andrew has contributed to 'Brearley and Bloch' on Restraint of Trade and employment covenants, and is the author of the statutory annotations of the 2006 Transfer of Undertakings (Protection of Employment) Regulations contained in leading loose-leaf publication.   

Commercial Law

Andrew carries out a wide range of civil and commercial litigation, appearing regularly in the High Court and various county courts across the United Kingdom.  In the past 6 months, Andrew has acted for a children's charity in a commercial arbitration relating to a claim for breach of a franchise agreement, and has appeared in the High Court in an application to discharge an order (obtained by the Royal Bank of Scotland) for delivery up of a printing press.  Andrew is also currently acting for a Computer Software company in High Court litigation relating to the installation of allegedly faulty software. 

Further, Andrew has acted in a growing number of banking-law and commercial fraud cases.  In the last 12 months Andrew successfully recovered over £800,000.00 on behalf of a company which had invested heavily in a joint-venture agreement and has regularly acted for high-street banks in claims relating to overdraft charges.

Employment Law

Andrew is an employment law specialist.  He has a particular interest in Whistleblowing, TUPE and discrimination claims involving multiple parties.  In the last 12 months Andrew has acted in two high value multi-day whistleblowing claims (one acting as sole counsel the other being led by Andrew Stafford QC), he has acted as sole counsel in a 10 day multi-party sex harassment /victimisation claim; and acted in two week long trials on behalf of individuals suffering from HIV and the AIDS virus, suing their former employers for unfair dismissal, disability and sexual orientation discrimination.  Andrew also regularly acts on behalf of doctors and National Health Trusts in Wages Act claims relating to the pay-banding of doctors' salaries.  Recently Andrew has acted as sole counsel in both a high value TUPE claim, and on behalf of 10 individuals in an Equal Pay claim against a Local Authority.

Andrew regularly appears in the Employment Appeal Tribunal where he has recently successfully defended a claim involving allegations of apparent bias, extension of time limits and the applicability of the statutory disciplinary dismissal and grievance procedures.

  • Butterworths Employment Law Practice and Procedure - Andrew is the author / updater of the Chapter dealing with "a Week's Pay" 

 

  • Contributor to the Commission of Equality and Human Rights Website (Discrimination in Education) 

 

  • Recently written an article for ELA Brief regarding multiple respondents in discrimination  cases; and

 

  • Regularly contributes to Tolly's Employment Law Newsletter - "the view from Littleton Chambers"

 

  • Andrew regularly lectures on all areas of Commercial and Employment Law.
