Littleton barristers have extensive experience appearing in and advising on the full ambit of human rights cases under the Human Rights Act 1998, European Convention of Human Rights and other international human rights instruments such as the UN Convention on the Rights of Persons with Disabilities and the International Labour Organisation Conventions.

Our barristers have particular experience in the following areas:

  • Article 5: liberty: expertise in both private law and public law proceedings challenging the lawfulness of detention
  • Article 6 EHCR: right to a fair and impartial hearing. Our barristers have appeared in some of the most major cases in the appellate courts, including R (G) v Governors of X School[2012] 1 AC 167 which concerned when Article 6 ECHR will apply to internal disciplinary hearings. Our barristers are adept at deploying Article 6 ECHR arguments in civil litigation and in disciplinary or regulatory proceedings
  • Article 8 ECHR: right to private and family life. Our barristers have extensive experience arguing and advising on Article 8 ECHR. Particular areas of specialism include employee privacy and confidentiality and immigration 
  • Article 9 ECHR: freedom of religion. Particular areas of specialism include religious schools, manifestation of religion in the workplace, religious charities and employment status within organised religions.
  • Article 10 ECHR: freedom of association, especially in the context of the rights of trade unions and their members, industrial action and trade union recognition
  • Article 11 ECHR: freedom of expression, particularly in the context of the employment sphere
  • Article 1 Protocol 1: deprivation of property. Our barristers have substantial experience in litigation involving sanctions, in disciplinary and regulatory proceedings and before the European Court of Human Rights
  • Article 2 Protocol 1: the right to education.
