SAM NEAMAN WINS HIGH COURT ESTATE AGENCY FRANCHISE CLAIM

In C21 London Estates Ltd v Maurice Macneill Iona Ltd [2017] EWHC 998 (Ch) Littleton’s Sam Neaman, leading Andy Feld from 20 Essex Street, has obtained judgment for his client, the Claimant, in a High Court claim for the wrongful termination of his client’s franchise of the Chelsea “Century 21” estate agency.

The case is of note for the court’s authoritative and detailed analysis of several important areas of contract law, including the test for when a term of a contract is a condition (paragraphs 64 – 84), the test for when a breach amounts to a repudiation of a contract, and the interrelationship between repudiation and renunciation (paragraphs 85-99).
